Host’n’Post respects the intellectual property rights of others and expects users of our platform to do the same. This Copyright Policy explains how copyright owners may report allegedly infringing content on Host’n’Post, how users may respond if their content is removed, and how Host’n’Post handles repeated copyright infringement. 1. User-Generated Content Host’n’Post allows users to upload and share content, including videos, photos, stories, event details, messages, event descriptions, and other materials. Users are responsible for the content they upload, post, or share through Host’n’Post. Users must not upload, post, or share content that infringes the copyright, trademark, privacy, publicity, or other rights of any person or third party. This includes, but is not limited to, copyrighted music, videos, photos, logos, artwork, or other protected material that the user does not own or have permission to use. 2. Copyright Complaints and DMCA Notices If you believe that content available on Host’n’Post infringes your copyright, you may submit a copyright complaint to our designated copyright agent. Your physical or electronic signature, or the signature of a person authorized to act on behalf of the copyright owner. 2. Identification of the copyrighted work that you claim has been infringed. 3. Identification of the content on Host’n’Post that you claim is infringing, including enough information for us to locate the content, such as a URL, username, event name, screenshot, video ID, or other relevant details. 4. Your contact information, including your full name, mailing address, telephone number, and email address. 5. A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law. 6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner. Copyright complaints should be sent to our designated copyright agent using the contact information listed above. 3. Removal of Allegedly Infringing Content When we receive a valid copyright complaint, we may remove or disable access to the allegedly infringing content. We may also notify the user who posted the content and provide information about the complaint, including information needed for the user to respond. Host’n’Post may remove content without prior notice if we believe it may infringe third-party rights or violate our Terms of Service. 4. Counter-Notice If your content was removed or disabled because of a copyright complaint and you believe the removal was a mistake or misidentification, you may submit a counter-notice. A valid counter-notice should include: 1. Your physical or electronic signature. 2. Identification of the content that was removed or disabled and the location where it appeared before it was removed or disabled. 3. A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification. 4. Your full name, mailing address, telephone number, and email address. 5. A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, that you consent to the jurisdiction of a federal district court in the United States, and that you will accept service of process from the person who submitted the original copyright complaint or their agent. Counter-notices should be sent to our designated copyright agent using the contact information listed above. If we receive a valid counter-notice, we may forward it to the person who submitted the original copyright complaint. We may restore the removed content within the timeframe allowed by law, unless the copyright owner informs us that they have filed a legal action seeking a court order to prevent the user from engaging in the allegedly infringing activity. 5. Repeat Infringer Policy Host’n’Post may suspend or terminate users who repeatedly infringe third-party copyrights or other intellectual property rights. We may also suspend or terminate accounts that repeatedly receive valid copyright complaints, upload infringing material, attempt to bypass copyright enforcement, or otherwise misuse the platform. 6. No Legal Advice Host’n’Post cannot provide legal advice or determine complex copyright disputes between users and rights holders.
